Essay: 谢振礼
Crime rates are one of few factors disrupting the way of a nation’s security, and the situation has to be put under control by punishing criminals. Some people believe that fixing the similar punishment for all those who commit each kind of crime is better, while others claim that punishment for all crimes should be flexible. On balance, it can be argued that it is unfair to punish a person without investigating the circumstances leading that person to a crime.
There are some good arguments for having one set of punishment for each crime. Every nation needs a system where the punishment fits the crime, not less, not more. Sentences for each type of crime should be given accordingly and having a fixed punishment is easy, fair, effective and efficient justice system. Among others, there is one important advantage about a fixed system as, before committing a crime, people would be aware of the results and would think twice before doing it. Another advantage is that a fixed punishment for each type of crime is tailored, anticipated and expected, and not arbitrary. Still another advantage is that since the punishment for each crime has already been given in law books, judges would only have to pronounce the verdict, and there will be no more complaints about the corruption in the judiciary system.
However, this system of fixing a punishment for each type of crime can also promote a wrong message in public. Although every nation has a right to take action against a criminal, it is definitely not correct to give the same punishment to all, without knowing the nature of the crime. Therefore, a fixed punishment is not always the best way because when deciding on the punishment of a person, the conditions and incentives for committing it must be taken into account. For example, a thief is a thief, but there is a difference between one thief stealing due to hunger and another thief stealing for profit. Likewise, a murder is a murder, but there is difference between killing someone for robbery and killing someone for self-defense. In other words, punishments should be flexible enough.
As a whole, although there are obvious advantages about a fixed punishment for each type of crime, nevertheless it is important for judges to take into consideration the circumstances of an individual crime in the first place. Opinions may differ regarding punishments, but each must pay a price, depending on the motivation of a person. In all events, for the security of a country, crimes must be reduced.
